The East Java Regional Police officially raised the legal status of the building collapse case

Head of Public Relations of the East Java Regional Police, Police Commissioner Jules Abraham Abast, said that this increase in status was decided after a case was held, Tuesday (8/10) evening.
“We from the East Java Regional Police have carried out a case title. So yesterday we carried out a case title and the result is that since yesterday the status has also been upgraded from an investigation process to an investigation,” said Jules at the Bhayangkara Hospital, East Java Regional Police, Surabaya, Thursday (9/10).

He explained that after this status increase, investigators immediately began the stage of summoning witnesses and asking for information from experts.The results of the expert examination will later become part of the evidence for the criminal proof process.
“We will immediately start the process of summoning witnesses, then asking for expert information which will later become one of the pieces of evidence in the process of proving criminal incidents,” he said.
Previously, during the investigation stage, they had examined 17 witnesses since the start of the incident on September 29 2025.However, the number of witnesses is certain to increase.
“Of these 17 witnesses, which ones need to be investigated and will be recalled later, based on the investigators’ needs,” explained Abast.
When asked about the background of the 17 witnesses, Jules said that they came from various groups who had a direct connection to the incident.
“The background can be a variety of backgrounds, which of course must be relevant to the incident. If we only know in passing or come too late, we might not delve into it,” he said.
Previously, East Java Regional Police Chief Inspector General Nanang Avianto said that his party had found criminal elements in the tragedy of the collapse of the Al Khoziny Islamic Boarding School building, Buduran, Sidoarjo.
Based on initial suspicions, Nanang said that the cause of the collapse of the three-story building was due to construction failure.
“There was a building collapse there, the men’s dormitory prayer room which was in the process of construction and casting. The initial suspicion was that the cause was construction failure. Failure of contraction,” said Nanang at the Bhayangkara Regional Police Hospital, East Java, Surabaya, Wednesday (8/10).
Nanang said that law enforcement steps had actually been taken by the Sidoarjo Police since the beginning of the incident, by issuing a police report number LP/A/4/IX/2025/SPKT.UNITRESKRIM/POLSEK BUDURAN SIDOARJO POLRESTA/EAST JAWA POLDA.
The East Java Regional Police have also formed a special team to investigate the Al Khozini tragedy.Which consists of two directorates at once, namely the Special Criminal Investigation Directorate (Ditreskrimsus) and the General Criminal Investigation Directorate (Ditreskrimum).
He has also revealed four articles that will be charged against the person responsible for the incident, although he has not named them.
The first is that Article 359 of the Criminal Code regulates penalties for someone who, through negligence, causes another person to die.
Then Article 360 of the Criminal Code regulates penalties for negligence (negligence) which causes serious injuries to another person.
“The articles that we will suspect here are Article 359 of the Criminal Code and/or Article 360 of the Criminal Code, negligence which causes death and/or serious injury,” said Nanang.
Then, Article 46 paragraph 3 and Article 47 paragraph 2 in Law Number 28 of 2002 concerning Buildings.The two articles discuss administrative and criminal sanctions for violations of building construction regulations,
“Then we also apply Article 46 paragraph 3 and/or Article 47 paragraph 2 of Law Number 28 of 2002 concerning Buildings, related to fulfilling building technical requirements,” he said.
The three-story building including the prayer room at the boys’ dormitory at the Al Khoziny Islamic Boarding School in Buduran, Sidoarjo, collapsed, Monday (29/9) afternoon.
At the time of the incident, there were hundreds of students performing Asr prayers in congregation in the building which was still under construction.
Until the end of the search, Tuesday (7/10), Basarnas recorded a total of 171 victims of the collapse of the Al Khoziny Islamic Boarding School building.Consisting of 104 survivors, 67 died, including 8 body parts.
As of Thursday (9/10) evening, the identities of 48 victims’ bodies had been identified through the identification process by the DVI Team at the Bhayangkara Regional Police Hospital, East Java, Surabaya.
