According to Hasanuddin, the TNI needs to clarify this after the consultation they did with the National Police.
“It needs to be explained clearly by the TNI Headquarters or Dansatsiber, what actions are taken by Ferry Irwandi so that it is considered to threaten the cyber defense within the Ministry of Defense and the TNI,” he said when contacted on Wednesday (10/9).
Hasanuddin admitted that he was doubtful with the alleged crime committed by Ferry.He referred to the decision of the Constitutional Court (MK) which said the defamation of the institution could not be processed in a criminal manner.
“The Constitutional Court’s decision has been firmly stated, defamation can only be processed by criminal law if addressed to individuals, not institutions,” said the two -star TNI retired.
Commander of the TNI Headquarters Siber Unit, Brigadier General Juinta Omboh Sembiring previously claimed to find alleged criminal acts committed by Ferry Irwandi.The findings, according to Juinta, were based on the results of cyber patrols which were then consulted to the Jakarta Metropolitan Police on Monday (8/9).
Four TNI personnel commanders were present on the occasion.They namely Danstsiber TNI Brigadier General Juinta Omboh Sembiring, Danpuspom Maj. Gen. Yusri Nuryanto, TNI Head of TNI Brigadier General (Mar) Freddy Ardianzah, and Kababinkum TNI Laksda Farid Ma’ruf.
“Our consultation is related to us finding the results of the cyber patrol, we found some facts of the alleged criminal acts committed by Brother Ferry Irwandi,” said Juinta.
Hasanuddin explained, based on the 2014 Cyber Defense Defense Defense Guidelines, the TNI Cyber Defense Function only applies internally within the Ministry of Defense and the TNI.
He therefore asked the TNI to correct Ferry Irwandi’s actions to be considered to violate the law or threaten cyber defense.This, he continued, so that the public gets a clear understanding.
The PDIP politician also reminded that the TNI did not take steps that caused multiple interpretations or obscured the limits of authority between freedom of expression, individual rights, and institutional authority.
Meanwhile, through the video uploaded on his Instagram account @irwandiferry, Ferry claimed not to know about the alleged criminal suspicion.
In the video, Ferry also stated that he was ready if he had to undergo a legal process.He was also not afraid of the TNI’s actions.
“If for example this action is considered to make me afraid, worry, worry, no. I will live, I will not play Victim, whining, no. If you really want to be processed by law, this is a rule of law, we live together,” he said.
